  • Obtained jury verdict of $1.275 million as lead counsel in employment discrimination lawsuit in Federal Court, the 11th largest Massachusetts verdict of 2017 (attorneys’ fees and costs awarded after trial) 
  • Awarded directed verdict after plaintiff’s opening statement as lead counsel in lawsuit alleging defamation, intentional infliction of emotional distress, and trespass in Nantucket Superior Court 
  • Member of trial team that obtained jury verdict of $243,000 on claims of breach of contract, breach of fiduciary duty and negligent misrepresentation in connection with a hedge fund management company (Affirmed on Appeal) 
  • Obtained arbitration award on behalf of homeowner against contractor, with the award later being confirmed in court
  • Obtained judgment on behalf of a tradesman in lawsuit against developer

  • Currently litigating a discrimination and retaliation lawsuit against large employer related to COVID-19

  • Argued successfully in favor of dismissal of three patent claims in federal lawsuit

  • Obtained judgment in excess of $245,000 in collection action on behalf of company
  • Litigated claims concerning the sale of a business on behalf of former owners, leading to mediated resolution

Agency Practice

  • Currently defending several Charges of Discrimination against employers
  • Obtained lack of probable cause finding from the Massachusetts Commission Against Discrimination concerning a claim of sexual harassment 
  • Obtained lack of probable cause finding from the Massachusetts Commission Against Discrimination concerning a claim of age discrimination 
  • Defended claim before the New York City Commission on Human Rights concerning background checks, leading to resolution
  • Obtained dismissal of claim concerning disability discrimination and award of sanctions against complainant’s law firm

Employment Law

  • Obtained consent judgment against three former employees and a competitor in connection with non-competition and non-solicitation agreements
  • Successfully argued in favor of denial of preliminary injunction involving an employee’s social media posts, which Massachusetts Lawyers Weekly called “one of the biggest unresolved questions in employment law”
  • Assisted numerous employees in resolving non-competition, non-solicitation and confidentiality obligations short of litigation
  • Represented clients in connection with wage and hour compliance and charges of discrimination before the Massachusetts Commission Against Discrimination (MCAD), Equal Employment Opportunity Commission (EEOC), in court and in arbitration.

Business Law

  • Serve as outside general counsel for companies, including those in the staffing, technology, real estate and restaurant industry
  • Assist new companies with “start-up” packages, including template offer letters, agreements for  non-competition and non-disclosure, and payroll guidance
  • Work with existing companies to refine and update their policies and procedures and advise concerning changes in the law
  • Counsel clients in connection with asset purchase agreements and commercial leases

Construction Law Experience

  • Represent contractors, subcontractors and design professionals in lawsuits and arbitrations concerning construction projects in Massachusetts
  • Successfully argued in support of dismissal of wrongful death lawsuit against client arising out of dam project.
  • Obtained summary judgment in lawsuit against client seeking contribution and indemnification in connection with a hospital construction project
  • Awarded summary judgment in wrongful death lawsuit against engineer arising out of fatal traffic accident

Personal Injury Experience

  • Secured $500,000 settlement on behalf of a minor and parents in a dog bite claim
  • Obtained $130,000 settlement on behalf of pedestrian hit by a car in a crosswalk
  • Negotiated $125,000 settlement on behalf of a business owner who slipped and fell on black ice
  • Obtained settlement of behalf of minor who sustained injuries in a slip and fall near school
  • Resolved claim on behalf of a bicyclist who was struck by a vehicle

Appeals

  • Preserved age discrimination jury verdict on appeal to the United States Court of Appeals for the First Circuit
  • Successfully persuaded the United State Supreme Court to deny certiorari denied in employment discrimination appeal
  • Secured denial of appeal to Massachusetts Court of Appeals and further appellate review to the Supreme Judicial Court of Massachusetts, affirming directed verdict
